Determining Child Support

Generally, the non-custodial parent must pay child support since the custodial parent already provides a vast amount of support for the children.

A judge will consider several factors when determining child support, such as:

  • The needs and income of the custodial parent
  • The ability and income of the parent who is paying child support
  • The financial needs of the children, such as daycare, education, insurance, or other special needs
  • The children’s standard of living before the divorce or separation

Both parties must provide a detailed account of their financial situation to the court, including their expenses and monthly income.

Determining Child Custody

A judge will also consider several factors before determining child custody and visitation. When it comes to children, a judge will always put their best interests first.

In a child custody case, a judge will consider the following factors when rendering a decision on custody and visitation:

  • The age of the children
  • The overall health and well-being of the children
  • The children’s emotional ties to each parent
  • The ability of each parent to provide emotional, physical, and financial care for the children
  • Any history of substance abuse or domestic violence
  • The children’s ties to the local community, school, or home

In some cases, if the children are older and more mature, a judge might consider their opinion as well. However, children cannot request which parent they wish to stay with since their choice might not necessarily serve their best interests.

Types of Custody in California

There are two types of custody a parent could be awarded:

  • Legal custody, which covers various aspects of the child's upbringing, such as where they go to school, how involved they are in religion or if they are even raised religious, what doctors they go to, and even their extracurricular activities.
  • Physical custody, which covers where and with whom the child lives. This does not necessarily mean that a parent with full custody can get up and move out of state with their child, however—especially if the other parent has visitation rights.

What's the Difference Between Sole Custody and Joint Custody?

Sole custody is when one parent is granted full parental rights, or "full custody," of the child. This may mean that the child lives primarily with them (physical custody) or that they have the final say over any and all decisions related to the child's health, education, and religion (legal custody).

On the other hand, joint custody means that both parents share these responsibilities. That is why joint custody is also commonly referred to as "shared custody."

Please note that joint custody is not always shared 50/50.
