California Law Governing Grandparents’ Rights

Family Code Section 3102
If one of the child’s parents has died, the grandparents of the deceased parent may petition the court for visitation rights.

Family Code Section 3103

Family Code Section 3104

When both parents agree to deny visitation, California law creates a rebuttable presumption that grandparent visitation isn’t in the child’s best interest. A similar presumption applies when the parent with sole legal and physical custody objects, or when the parent with whom the child resides objects and there is no operative custody order in place.
